Senate Advances Bill Allowing State Agencies to Expand Their Regulatory Scope

The Michigan Senate approved legislation this week allowing state agencies to create regulations stricter than federal rules and standards.

Under current law (PA 602 of 2018), state agencies may not adopt or promulgate rules more stringent than federally-mandated ones–except when there was a clear and convincing need for such action or existing state law exceeds the applicable state standard. Current law seeks to find a balance between limiting the state from overzealous rulemaking and giving Michigan a level of autonomy and the ability to meet any changing regulatory needs.

Senate Bill 14, which was approved by a vote of 20-18 in the Senate on May 17, would ultimately do away with this notion.  The Chamber has voiced opposition to the legislation because it sends a message that Michigan is preparing for regulatory overreach and not open for business. A level playing field, along with clear and consistent expectations, are key factors in a job provider’s decision-making process and an uncertain and changing regulatory climate ties directly into that calculation.
