Reminder: ESTA notification letters to employees due this week!

Advocacy News – March 18, 2025 

Michigan employers must provide written notice all employees outlining their Earned Sick Time Act (ESTA) choices no later than this Sunday, March 23.

Why it matters: ESTA, which took effect March 21, requires employers to provide a written notice to employees within 30 days after the effective date of ESTA (March 23, 2025) or at the time of hire, whichever is later. The notice must include the following:

  • The amount of earned sick time required to be provided;

  • The employer’s choice of how to calculate a year;

  • The permissible uses for how earned sick time may be used;

  • That employers may not retaliate against employees for taking earned sick time; and

  • The employee’s right to file an administrative complaint with the MI Department of Labor & Economic Opportunity for any violation of the MI ESTA.
