Michigan Chamber joins lawsuit challenging illegal price control scheme

Legal News – June 9, 2023

(LANSING, Mich.) – The Michigan Chamber of Commerce released the following statement from President & CEO Jim Holcomb after joining the U.S. Chamber and the Ohio and Dayton Area Chambers of Commerce in a lawsuit filed today in the Southern District of Ohio to stop the Department of Health and Human Services (HHS) from implementing new government price control provisions in the federal Inflation Reduction Act (IRA).

“While stemming rising health care costs is a key priority for the Michigan Chamber, these provisions take a misguided—and illegal—approach to controlling the cost of pharmaceutical drugs. From arbitrary price controls to a deceptively named ‘negotiation’ process, the IRA will lead to less access to critical lifesaving treatments and sets a dangerous precedent – harming patients and stifling innovation.”

Holcomb added that the suit seeks to block the IRA provisions because they are a violation of several fundamental constitutional protections and have long-term implications for free enterprise and U.S. competitiveness.
