Legislation Requiring New Data Security Mandates Advances

HB 4186 and HB 4187, both sponsored by Representative Farrington, moved out of the Senate Regulatory Reform Committee earlier this week. The legislation imposes new data security regulations on businesses with more than 50 employees.

The most significant change contained in the package from current law is a requirement that a business must notify individuals of a breach within 45 days of one occurring. The 45-day clock will begin once a business fully understands the scope of the breach and has restored integrity to their system.

This legislation has been painstakingly negotiated with the bill sponsor to ensure the legislation is reasonable and does not set up a business for failure. The full Senate is expected to vote on the bill next week.
