Feedback needed on plan to require employer disclose of paid leave benefits

The Senate Economic & Community Development Committee is expected to hold a hearing soon on legislation to require employers with one or more employees to disclose their family leave policy to all potential employees before the employer makes an employment offer. The disclosure, which may be conveyed in writing or electronically, must include the amount of family leave available before and after the birth or adoption of a child.

Why it matters: While it’s common practice for employers to share HR policies when an employment offer is extended or during the onboarding process, the proposed legislation would require disclosure before an offer of employment is made.

  • While the legislation does not require employers to keep record of these communications, employers failing to comply would be subject to a $1,000 civil fine.

  • Additionally, the legislation would authorize a “prosecutor of the county in which the violation occurred or the attorney general” to bring an action to collect the fine.
