What’s happening: The Senate Energy and Environment Committee recently took testimony on Senate Bill 947, legislation that would expand state regulatory authority over certain federally licensed hydroelectric dams. The Michigan Chamber raised concerns that the proposal conflicts with existing federal law and court precedent, creating legal uncertainty for dam operators.
Why it matters: Michigan is home to nearly 100 hydroelectric dams regulated under federal law. As policymakers consider ways to improve dam safety and oversight, it’s important to avoid duplicative or conflicting regulatory requirements that could create confusion, increase costs and complicate infrastructure management.
What we’re saying: Federal law already provides a comprehensive regulatory framework for hydroelectric dams through the Federal Energy Regulatory Commission (FERC). The Chamber is concerned SB 947 could create overlapping state and federal requirements, leading to legal challenges and uncertainty without improving dam safety outcomes.
